1. About these terms
These Website Terms of Service ("Terms") govern access to and use of use131.com (the "Website"), including its articles, resources, forms and Information Health Check.
The Website is operated by 131 Built LLC, a Florida limited liability company ("131", "we", "us" or "our").
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website. The Website is intended primarily for business and professional users who are at least 18 years old.
2. Website purpose
The Website provides information about built-asset information management, ISO 19650, BIM practices and the services offered by 131. It also provides articles, general resources, enquiry forms and an initial Information Health Check.
Website content is provided for general informational purposes. It is not a substitute for an assessment of a particular organisation, project, asset, system, contract or regulatory requirement.
3. Enquiries and professional services
You may use the Website or the contact details provided to make a general enquiry or express interest in a service. An enquiry, form submission, email, meeting or discussion does not by itself:
create a client, advisory, fiduciary or other professional relationship;
require 131 to accept an engagement or provide a service;
constitute an offer or acceptance capable of forming a service contract; or
create an obligation of confidentiality beyond applicable law and any separate written agreement.
Any paid review, assessment or other professional service will be described in a separate written proposal, scope of work, engagement letter or services agreement (a "Service Agreement"). A service engagement begins only when the applicable Service Agreement has been accepted in the manner stated in that document.
The Service Agreement will govern the relevant service, deliverables, responsibilities, assumptions, fees, timetable, use rights, confidentiality, liability and other engagement-specific matters. If a Service Agreement conflicts with these Terms in relation to a paid service, the Service Agreement controls.
4. Information Health Check
The Information Health Check is a preliminary diagnostic intended to provide an initial indication of how information may support the decisions it is intended to inform. Its usefulness depends on the accuracy, completeness and context of the information submitted.
The Health Check is not:
a formal audit, certification or compliance determination;
a complete review of an organisation's information-management arrangements;
professional verification of drawings, asset information or technical content;
legal, engineering, architectural, fire-safety, health-and-safety or regulatory advice; or
a guarantee that all gaps, risks, errors or opportunities have been identified.
Health Check results should be considered in context and, where appropriate, followed by a separately scoped review or advice from a suitably qualified professional. Submission of a Health Check does not require 131 to accept a subsequent engagement.
5. ISO 19650, BIM and third-party standards
References to ISO 19650, BIM, British Standards, industry frameworks or other third-party standards are provided to describe the subject matter of the Website and our work. Unless expressly stated otherwise in a Service Agreement:
131 does not provide certification or accreditation;
131 is not a certification body;
use of a standard's name does not imply endorsement, sponsorship or affiliation with its publisher or any standards body; and
users remain responsible for obtaining authorised copies of applicable standards and determining which legal, contractual and technical requirements apply to their circumstances.
ISO, BSI and other names or marks belong to their respective owners. Nothing on the Website grants a right to reproduce or distribute third-party standards.
6. No professional or regulatory reliance on Website content
Although we aim to present accurate and useful information, Website content may be general, incomplete, simplified or affected by changes in law, standards, guidance or industry practice. You are responsible for evaluating its relevance to your circumstances.
Do not rely solely on the Website or the free Health Check to make decisions involving legal or contractual compliance, design, engineering, construction, asset safety, fire safety, health and safety, regulatory duties, professional certification or material financial risk. Obtain appropriate project-specific and professionally verified advice where required.
This section applies to Website content and free resources. Deliverables supplied under a Service Agreement are governed by that agreement.
7. Information you submit
When you submit information through the Website or by email, you confirm that:
the information is accurate to the best of your knowledge;
you have authority to provide it and to request the relevant response or service;
providing it does not violate law, contract, confidentiality, intellectual-property or third-party rights; and
it does not contain malicious code or material intended to disrupt the Website or our systems.
Please provide only the information reasonably needed for your enquiry or Health Check. Do not submit trade secrets, security-sensitive material, personal information about others, or information subject to confidentiality restrictions unless you are authorised to do so and appropriate arrangements are in place.
You retain ownership of material you submit. You grant 131 a non-exclusive, worldwide, royalty-free licence to receive, store, copy, review and use that material only as reasonably necessary to respond to your enquiry, provide the Health Check, prepare a proposed scope of work, deliver an agreed service, administer our relationship, comply with law and protect legal rights.
Personal information is handled as described in our Privacy Policy.
8. Intellectual property
The Website and its original content, including its text, articles, graphics, branding, layout, Health Check questions, review descriptions, diagrams, selection and arrangement, are owned by or licensed to 131 and are protected by copyright, trademark and other intellectual-property laws.
Subject to these Terms, you may view the Website and print or save a reasonable number of pages for your internal, non-commercial reference. You may not, without prior written permission:
reproduce, republish, distribute, sell, license or commercially exploit Website content;
remove copyright, attribution or proprietary notices;
use Website content to create a competing product, service, assessment or dataset;
systematically scrape, harvest or extract Website content or form questions;
use Website content to train or evaluate an artificial-intelligence or machine-learning system; or
imply that 131 endorses, certifies or is affiliated with you or your organisation.
Limited quotation with proper attribution may be permitted where allowed by applicable law. To request permission, contact hello@use131.com.
9. Acceptable use
You must not:
use the Website unlawfully, fraudulently or in a way that infringes another person's rights;
attempt to gain unauthorised access to the Website, its infrastructure, forms, accounts or data;
introduce malware, harmful code, automated attacks or unreasonable traffic;
interfere with the Website's availability, security or operation;
impersonate another person or misrepresent your authority or affiliation;
submit false, misleading, abusive or unlawful material; or
use automated means to access or interact with the Website except ordinary search-engine indexing or with our prior written permission.
We may restrict or block access where we reasonably believe these Terms have been breached or the Website, 131 or another person may be at risk.
10. Third-party links and resources
The Website may link to standards bodies, publications, professional resources and other third-party websites. Links are provided for convenience and context. We do not control or endorse third-party content and are not responsible for its accuracy, availability, security, terms or privacy practices.
11. Website availability and changes
We may change, update, suspend or withdraw any part of the Website, including a resource or free tool, at any time. We do not guarantee that the Website will always be available, uninterrupted, error-free or free from harmful components. You are responsible for maintaining appropriate security, software and backups on your own systems.
12. Disclaimers
To the fullest extent permitted by law, the Website and its content and free tools are provided "as is" and "as available". 131 disclaims all warranties relating to the Website, whether express, implied or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title and non-infringement.
We do not warrant that Website content is complete, current or suitable for a particular purpose, or that use of the Website will produce a particular result. Nothing in these Terms limits an express commitment made in a Service Agreement.
13. Limitation of liability
To the fullest extent permitted by law, 131 and its members, managers, employees, contractors and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss arising from or relating to the Website, including loss of profit, revenue, opportunity, anticipated savings, goodwill, business interruption or data.
For claims arising solely from use of the Website, Website content or a free tool, and not from a paid service governed by a Service Agreement, 131's total aggregate liability will not exceed US $100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law prohibits such an exclusion.
Liability relating to a paid service is governed by the applicable Service Agreement.
14. Privacy
Our Privacy Policy explains how we collect and use personal information. By submitting personal information through the Website, you acknowledge that it will be handled as described in that policy.
15. Governing law and disputes
These Terms and any non-contractual dispute arising from the Website are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Subject to any mandatory law that applies, the state and federal courts located in Florida will have exclusive jurisdiction.
If you access the Website from another jurisdiction, you remain responsible for compliance with local law. Nothing in these Terms removes a right or remedy that applicable law does not permit the parties to exclude.
16. General provisions
If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary or, if modification is not possible, severed. The remaining provisions will continue in effect.
Failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, restructuring, sale of assets or transfer of the Website or business.
These Terms, together with the Privacy Policy, constitute the entire agreement concerning use of the Website. They do not replace or amend a Service Agreement.
17. Changes to these terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated date. Continued use of the Website after an update means you accept the revised Terms to the extent permitted by law.
